Abstract
The article analyzes public policies for the realization of the right to memory and truth in Brazil, highlighting their historical development and the importance of public spaces for discussion on the topic. Based on Jürgen Habermas’ theory of the public sphere, the text explores how memory and truth are recovered and institutionalized as fundamental rights. The study examines the National Human Rights Program (PNDH), focusing on Axis VI, which addresses the investigation and clarifi cation of violations that occurred during the military dictatorship. It also discusses the creation of the National Truth Commission (CNV), its role, and the challenges it faced, especially in the political and social context of its implementation. The article argues that while the CNV fulfi lled its role in investigation and documentation, its ability to promote justice and prevent the recurrence of violations depends on the continuity of
public policies and societal engagement. As a conclusion we can say that the right to memory and truth, although made public, still faces institutional resistance and obstacles that hinder its possible realization.
